Nevada's consumer privacy legislation consists of two laws: SB 220, signed on May 29, 2019, and SB 260, signed on June 2, 2021. Together they give Nevada consumers the right to opt out of the sale of their personal information collected online. Nevada's law is narrower in scope than comprehensive state privacy laws such as the CCPA or VCDPA, focusing specifically on the sale of covered information by operators of websites and online services.
Nevada's privacy law (NRS Chapter 603A) requires operators of websites or online services that collect covered information from Nevada consumers to include a clear opt-out mechanism in their privacy notices. It does not create broad consumer rights such as access, correction, or deletion, nor does it require opt-in consent for sensitive data.
SB 260 (2021) extended the opt-out right to cover sales to data brokers and clarified the definition of "sale" to align more closely with the CCPA.
Nevada's privacy law applies to operators of websites or online services that collect covered information from Nevada consumers and do business in Nevada or target Nevada residents. There are no minimum consumer or revenue thresholds — the law applies broadly to any operator meeting these criteria.
Exemptions include financial institutions subject to GLBA, HIPAA-covered entities, and certain other regulated entities.

Operators must respond to a verified opt-out request within 60 days, with a possible 30-day extension when reasonably necessary.
Covered information under Nevada's law includes first name or initial and last name, home or other physical address, email address, telephone number, Social Security Number, identifier that allows a specific person to be contacted physically or online, and any other information collected in combination with the above.
The Nevada Attorney General enforces Nevada's privacy law. Civil penalties of up to $5,000 per violation may be imposed. There is no private right of action.
